Terms & Conditions

These Terms of Use ("Terms") apply to the Quitzilla iOS app ("Quitzilla", "the app"), developed and operated by despDev ("we", "us"). They supplement Apple's Standard End User License Agreement and the Apple Media Services Terms, which also apply to your use of Quitzilla and to App Store purchases. If these Terms conflict with applicable Apple terms or mandatory law, the applicable Apple terms or mandatory law control.

By downloading or using Quitzilla, you agree to these Terms. If you do not agree, do not use the app.

Eligibility

You must be at least 13 years old (or the higher minimum age required in your country) and have the legal capacity to agree to these Terms. If you are a minor, you may use the app only with the permission of a parent or guardian where such permission is required.

License and intellectual property

Subject to Apple's Standard EULA, we grant you a personal, non-exclusive, non-transferable license to use Quitzilla on Apple-branded devices that you own or control, as permitted by Apple's Usage Rules. You may not copy, modify, distribute, reverse engineer, or attempt to derive the source code of the app, except to the extent such a restriction is prohibited by applicable law or permitted by an applicable open-source license. Quitzilla and despDev-created content remain the property of despDev or its licensors; third-party components remain the property of their respective owners.

Acceptable use

You agree not to use the app for any unlawful purpose, interfere with its operation, circumvent its security or its Premium restrictions, or misrepresent your relationship with despDev.

Not medical advice

Quitzilla is designed as a self-improvement and habit-tracking tool. It is not a medical device and does not provide medical, psychological, diagnostic, or addiction-treatment advice. Do not use it as a substitute for advice, diagnosis, or treatment from a qualified professional. If you believe you or another person is in immediate danger, contact local emergency services.

Your data and security

The data you create in the app is stored on your device; how data is handled is described in our Privacy Policy. It is your responsibility to keep your device and access to the app secure. We recommend that you do not jailbreak your device, as this can compromise its security and may cause the app to work incorrectly or not at all.

Subscriptions

An optional auto-renewing subscription, "Quitzilla Premium", unlocks additional app features. The available duration, price, billing period, and any introductory offer or free trial are displayed immediately before purchase confirmation.

Refunds

Purchases and billing are processed by Apple. Refund eligibility is determined by Apple under its App Store rules and applicable law. You may submit a refund request at reportaproblem.apple.com; submitting a request does not guarantee that Apple will approve it. despDev cannot issue App Store refunds directly, because it does not process the payment. Nothing in this section limits any refund or withdrawal right that applicable law gives you.

Changes to the app and its features

We may update the app and its features, including Premium features, for technical, security, legal, or product reasons, and we may introduce new paid features. Prices, subscription duration, renewal terms, and any trial terms are always displayed before you confirm a purchase. We will provide reasonable notice of material changes where appropriate or required by law. Changes do not limit your rights to cancel, to request a refund from Apple, or to exercise mandatory rights under applicable consumer law. Future iOS or device changes may require app updates for the app to keep working correctly.

Disclaimer

To the maximum extent permitted by applicable law, Quitzilla is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee that the app will always be uninterrupted, error-free, or compatible with every future device or operating-system version. Statistics and estimates shown in the app — including money or time saved — are based on the information you enter and are provided for informational and motivational purposes only. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, despDev is not liable for indirect, incidental, special, consequential, or punitive damages, or for losses that were not reasonably foreseeable when you accepted these Terms. We do not exclude or limit liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded. Your mandatory consumer rights remain unaffected.

Termination

You may stop using Quitzilla at any time. Uninstalling the app does not cancel an active subscription; subscriptions must be canceled through Apple. We may discontinue future distribution or support of the app, or terminate your license if you materially breach these Terms, subject to applicable law. Discontinuation or termination does not limit any refund or consumer right provided by Apple's terms or applicable law.

Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be narrowed or removed to the minimum extent necessary, and the remaining provisions will remain in full force.

Changes to these Terms

We may update these Terms from time to time. We will post any changes on this page and update the date at the top. By continuing to use the app after changes take effect, you accept the updated Terms.
